Event Ticket Purchase Policy
Effective Date: March 12, 2026
The following policy governs the purchase of event Event Tickets made exclusively through our websites (collectively, the “Site”). This policy does not apply to purchases of travel packages that may include Event Tickets, accommodations, transportation, or other add-ons; a separate Travel Package Purchase Policy governs those purchases. This Event Ticket Purchase Policy forms part of and is incorporated into our Terms of Use.
Jampack acts as a marketplace and intermediary connecting purchasers with third-party suppliers including event organizers, ticket sellers, hotels, and travel providers. Jampack is not the operator of such services and shall not be responsible for the acts or omissions of such third parties.
This Event Ticket Purchase Policy is designed to ensure your satisfaction and understanding of the Event Ticket purchase process for live events on our Site. Please also review our Terms of Use, which govern your use of our Site, and your purchase, possession, or use of any Event Tickets, products, or services, and our Privacy Policy. If you have any questions, please contact us at wegotyou@jampack.com.
For purposes of this Event Ticket Purchase Policy, the term “Event Ticket” refers solely to a standalone admission credential (digital or physical) that grants entry to a specific live event. It does not include any bundled products or services such as lodging, transportation, meals, or other add-ons sold as part of a travel package, which are governed separately by the Travel Package Purchase Policy.
1. Claims & Complaints
If you have a complaint about your purchase, you must inform our Support Team immediately at wegotyou@jampack.com so that they can attempt to rectify the matter. We assume no liability for complaints that are not properly brought to the Support Team's attention with sufficient notice to resolve or attempt to resolve them. Any complaint must be received via the email associated with the purchase within 7 days of the event’s end. You acknowledge and agree that we have no obligation to respond to or address any claims received after this period or sent via methods not explicitly provided in this section.
2. Currency
All Event Ticket prices for events that occur in the United States are stated in U.S. Dollars, unless otherwise noted.
3. Payment Methods
We accept several methods of payment to accommodate your needs, including (among others) American Express, Visa, MasterCard, and Discover. You must provide us with a valid payment method, such as a credit or debit card ("Payment Method"). If you pay with a credit or debit card issued by Visa, MasterCard, American Express, or any other issuer accepted by us, your agreement with such issuer governs your use of such credit or debit card, and you must refer to that agreement and not these terms to determine your rights and liabilities. By providing us with a Payment Method, you agree to pay and we are authorized to immediately invoice your account for all service fees and charges due and payable to us hereunder in accordance with the fee, charge, and billing terms in effect at the time a fee or charge is due and payable, and that no additional notice or consent is required. You agree to notify us immediately of any changes to your billing address or Payment Method.
4. Who You Are Buying From
Event Tickets available through our Site may be offered either by Event Organizers (such as artists, venues, teams, fan clubs, promoters, or leagues) or by independent third-party sellers, including licensed ticket brokers and resellers. In some cases, we sell Event Tickets directly on behalf of the Event Organizer as their authorized agent, and in other cases tickets are listed and fulfilled by independent third-party sellers through our marketplace (“Resale Marketplace Tickets”). When you purchase Event Tickets through our Site, we facilitate the transaction and process payment, but we do not own, control, or guarantee ticket inventory supplied by Event Organizers or third-party sellers. Except where expressly stated, we do not act as the agent of buyers, sellers, Event Organizers, or venues in connection with ticket transactions facilitated through the Site.
Event Organizers, not us, are responsible for their events, including organizing, scheduling, staging, postponing, rescheduling, cancelling, and establishing policies governing the event. These policies may include refund policies, venue conduct rules, entry requirements, and other event-specific terms. Event Tickets purchased through our Site may therefore be subject not only to this Event Ticket Purchase Policy, but also to the terms, conditions, and policies established by the applicable Event Organizer and venue.
For Event Tickets fulfilled by independent third-party sellers, including Resale Marketplace Tickets, the third-party seller is solely responsible for listing accuracy and for transferring or delivering the tickets in accordance with the listing description and applicable delivery timeline. Resale Marketplace Tickets are not issued by, affiliated with, or endorsed by the applicable Event Organizer unless explicitly stated.
For certain listings, including some Resale Marketplace Tickets, the section and row (or comparable location description) may be displayed at the time of purchase while the specific seat numbers may not be available until after the purchase is completed. In such cases, the exact seat numbers will be provided when the tickets are delivered or transferred. Tickets may be delivered through electronic transfer, mobile ticketing platforms, digital wallets, downloadable files, or other delivery methods depending on the Event Organizer, venue, or third-party seller. By completing your purchase, you acknowledge and accept that seat numbers and delivery methods may be assigned or disclosed after checkout.
Entry to any event will be governed by the policies and rules established by the applicable Event Organizer and the venue where the event takes place. You acknowledge that by purchasing Event Tickets through our Site, you agree to comply with such policies and rules and understand that we are not responsible for enforcing or administering them.
Event Tickets obtained from unauthorized sources and not directly through our Site may be lost, stolen, counterfeit, or otherwise invalid and, if so, are void. All Event Ticket purchases made through our Site are covered by our Buyer Guarantee described in Section 10.
We act solely as an intermediary marketplace facilitating transactions between buyers and Event Organizers or third-party sellers. Except where we are expressly identified as the ticket seller, we are not the issuer of Event Tickets. We do not control the actions of Event Organizers, venues, or third-party sellers and are not responsible for their acts, omissions, errors, representations, warranties, breaches, or negligence.
Third-party sellers listing Event Tickets through our marketplace represent and warrant that they have the legal right to sell and transfer the tickets offered for sale and that such tickets will be delivered in accordance with the listing description and applicable delivery timeline. We do not independently verify ticket listings provided by third-party sellers, we are not responsible for inaccuracies, errors, or omissions in such listings, and we make no representations regarding the accuracy, authenticity, or availability of such listings except as provided under the Buyer Guarantee. If a third-party seller fails to deliver tickets as described, delivers invalid tickets, or otherwise cannot fulfill the order, our sole obligation shall be to provide replacement tickets of reasonably comparable value or issue a refund in accordance with our Buyer Guarantee.
5. Pricing and Availability
We sell Event Tickets on behalf of Event Organizers, which means we do not set Event Ticket prices or determine seating locations. Event Organizers typically set the face value of their Event Tickets. Event Tickets may be sold through multiple distribution points, including websites, applications, box offices, and other authorized channels. These distribution points often access the same ticketing system and inventory, and therefore Event Tickets for popular events may sell out quickly. Occasionally, additional Event Tickets may become available closer to the event date; however, we do not control ticket inventory or its availability.
Event Ticket prices displayed on the Site may be determined by Event Organizers, Marketplace Sellers, or dynamic market conditions and may be higher or lower than the face value printed on the ticket. Prices for Resale Marketplace Tickets are established by the applicable Marketplace Seller and may fluctuate at any time based on supply and demand for the event. Ticket prices displayed on the Site reflect the current market price for the ticket and may be higher or lower than the original face value printed on the ticket. Prices may include marketplace service fees, fulfillment costs, and other charges associated with ticket procurement. By purchasing Event Tickets through the Site, you acknowledge that ticket prices may exceed the original face value and that pricing reflects prevailing market conditions at the time of purchase.
Event Ticket prices may be dynamic and may increase or decrease at any time based on market demand, inventory availability, Event Organizer pricing decisions, or resale marketplace activity. Once a purchase is completed, ticket prices will not be adjusted, and we do not offer refunds, credits, or price adjustments based on subsequent price changes.
Prices for Resale Marketplace Tickets may be above or below the original face value. Please be aware that Event Tickets purchased from unauthorized resale sources outside of our Site may be lost, stolen, counterfeit, or otherwise invalid.
For some Event Ticket listings, including certain Resale Marketplace Tickets, the section and row (or comparable location description) may be displayed at the time of purchase, while individual seat numbers may not be available until after the purchase is completed. In such cases, the exact seat numbers will be assigned, disclosed, or transferred to you when the tickets are delivered. By completing your purchase, you acknowledge and accept that specific seat numbers may be provided after checkout.
While an Event Ticket may correspond to a general location within a venue, we do not guarantee specific rows or seat numbers. Location descriptions are provided to us by the Event Organizer, venue, or third-party seller and may not represent an exact seat location. Seating charts and venue maps displayed on the Site are provided for illustrative purposes only and may not reflect the final layout of the venue. Event Organizers and venues may modify seating arrangements, stage placement, row configurations, or venue layouts at any time, including after tickets are purchased. The actual seat location, section, row designation, or viewing angle may therefore differ from the location displayed at the time of purchase. Such changes, including the addition or removal of seats or sections, shall not entitle the purchaser to a refund, credit, or exchange unless otherwise required by applicable law or the Event Organizer’s policies.
We are not responsible for typographical, technical, or system errors in ticket listings. If an error is discovered during the order process, we reserve the right to cancel or refuse the order and will notify you of the issue. When possible, we may offer substitute tickets of comparable value at no additional cost. If a substitution is not available, a full refund will be issued to the original payment method. We reserve the right to cancel orders affected by pricing or listing errors regardless of whether the order has been confirmed or the payment method has been charged.
We may charge fees for fulfillment, shipping, service, or other services associated with purchases made through our platform. These fees may change from time to time. In addition, we may provide algorithmic guidance or tools regarding seat quality, pricing, or value. Such guidance is provided solely for informational purposes and without any warranty as to its accuracy or usefulness.
Please review your Event Tickets carefully once they are delivered and contact us promptly if you have any questions regarding your purchase.
For Event Tickets fulfilled by independent third-party sellers, including Resale Marketplace Tickets, the third-party seller is responsible for transferring or delivering the tickets in accordance with the listing description and delivery timeline. In the event a seller fails to deliver tickets as described, delivers invalid tickets, or otherwise cannot fulfill the order, we may, at our sole discretion, provide replacement tickets of comparable value or issue a full refund to the original payment method pursuant to our Buyer Guarantee. Replacement tickets may be located in a different section, row, or seating location than originally listed, depending on availability.
6. Order Confirmation and Processing
The Site operates as a technology platform that facilitates the listing and purchase of Event Tickets supplied by Event Organizers and third-party sellers. Ticket availability, inventory, pricing, and listing information are updated dynamically and may change rapidly due to demand and simultaneous purchasing activity across multiple distribution channels. As a result, tickets displayed as available at the time of viewing may become unavailable before an order is completed. We do not guarantee the availability of any Event Ticket until the transaction has been successfully processed and confirmed.
Your order is confirmed when we send you a confirmation, in the form of a confirmation page or email (“Order Confirmation”). We reserve the right, in our sole discretion, to cancel, limit, or refuse any ticket order if we believe the transaction may violate applicable law, purchase limits, anti-bot protections, or marketplace integrity policies. We may also cancel orders resulting from technical errors, pricing inaccuracies, inventory discrepancies, or suspected fraudulent activity. If an order is cancelled under this section, the purchaser’s sole remedy shall be a refund of the amount paid for the cancelled tickets. If you do not receive an Order Confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via your account whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation. In some instances, where the electronic Event Ticket is not yet available, the delivery update acts as your confirmation until the Event Ticket is delivered. Your order may be finalized even if you do not receive an Order Confirmation, finalized invoice, or updated status email from us. If you haven't heard from us, please contact us to check on the status of your order. Never assume the status of your order unless we have contacted you. Orders cannot be canceled due to issues with the email receipt. By purchasing an Event Ticket through our Site, you enter a binding contract with us and, as applicable, the Event Organizer. All sales are final, and, except as provided under our Buyer Guarantee (see below), you will not receive a refund for any completed purchase. You cannot change or cancel orders after a purchase has been completed.
If a third-party seller fails to deliver valid tickets for any reason, Jampack reserves the right, in its sole discretion, to provide replacement tickets of comparable or greater value, upgrade seat locations, or issue a refund pursuant to the Buyer Guarantee.
7. Service Fees, Order Processing Fees, Taxes, and Shipping Charges
Event Tickets purchased on our Site are typically subject to, among other possible fees, a per-Event Ticket service fee and a per-order processing fee. In some instances, you can purchase Event Tickets directly from the venue box office without paying our service fee. We collect tax as required by state and local laws. We may display the tax separately or include it in the total service fee amount. In many cases, you may need to pay a shipping or delivery fee. Shipping and delivery charges are calculated based on the delivery location and shipping method. Please note that the delivery fee and order processing fee may not accurately reflect the actual cost of delivering or processing your order, and in some cases, these fees may include a profit for us. Service fees and order processing fees may be subject to change. We reserve the right to change our service fees, billing methods, or payout methods at any time. We may retain service fees if you fail to fulfill your obligations under this agreement.
We reserve the right, in our sole discretion, to review, refuse, or cancel any order if we believe the order may be fraudulent, involve unauthorized payment methods, violate applicable law, or otherwise breach these Terms. We may require additional verification or information before processing an order. If an order is cancelled under this section, any payment received will be refunded to the original method of payment.
8. Number of Event Tickets or “Event Ticket Limits”
By purchasing Event Tickets on our Site, you may be limited to a specified number of Event Tickets for each event (an “Event Ticket Limit”). Event Ticket Limits are typically communicated during the purchase process and may be enforced through the functionality of our Site. These limits are established to provide all interested users with a fair opportunity to purchase Event Tickets and to discourage unfair, abusive, or prohibited ticket-buying practices.
Event Organizers may establish limits on the number of Event Tickets (including seats, parking passes, and other event-related access credentials) that may be purchased by a single user or household (each, a “Purchase Limit”). Event Tickets purchased through multiple transactions, accounts, purchasing sessions, or distribution channels may be aggregated for purposes of determining compliance with applicable Purchase Limits.
Each account used to purchase Event Tickets must be associated with a unique individual and must contain valid and verifiable information. The use of multiple accounts, identities, payment methods, devices, IP addresses, or other purchasing methods to circumvent or exceed any Purchase Limit is strictly prohibited. Automated purchasing methods, including the use of bots, scripts, or other automated tools designed to access the Site or purchase Event Tickets, are also strictly prohibited.
If you exceed or attempt to exceed any applicable Event Ticket Limit or Purchase Limit, we reserve the right, in our sole discretion, to cancel or revoke any associated orders or Event Tickets without notice, refuse future transactions, suspend or terminate associated accounts, or otherwise restrict your ability to purchase Event Tickets through our Site. Any refunds issued for orders cancelled due to violations of these limits may be issued at face value only and may exclude fees or other charges to the extent permitted by law.
For purposes of enforcing Event Ticket Limits and Purchase Limits, we may consider orders associated with the same or similar name, email address, billing address, shipping address, payment method, IP address, device identifier, account information, or other identifying information.
9. Event Ticket Delivery
You agree to provide us with the information necessary for the delivery of Event Tickets, including, as applicable, your email address and physical address. If you provide incomplete or incorrect information for the delivery of Event Tickets, or you are unavailable to receive the Event Tickets when they are delivered, you will not be eligible for a refund or our Buyer Guarantee.
Event Tickets may be delivered through mobile transfer, third-party ticketing systems such as Ticketmaster, AXS, or similar digital ticket platforms, determined by the Event Organizer or seller, and you may be required to create an account with such services to receive or access your tickets.
Delivery timing for Event Tickets may vary depending on the Event Organizer, venue, ticketing platform, or third-party seller. In certain cases, tickets may not be available for transfer or delivery until closer to the event date. For Resale Marketplace Tickets, delivery timing may depend on when the original issuer or venue releases tickets to the seller. Tickets may therefore be delivered closer to the event date. This is normal for many live events and does not constitute a failure of delivery. By completing your purchase, you acknowledge and accept the delivery timeline disclosed during checkout or in your order confirmation.
10. Buyer Guarantee
We want you to be able to buy Event Tickets with confidence. Accordingly, each Event Ticket purchase is covered by our Buyer Guarantee ("Buyer Guarantee"). Under the Buyer Guarantee, if your Event Tickets are not delivered as described, are invalid, or the event is canceled and not rescheduled, we will provide you with a full refund or, at our discretion, replacement Event Tickets of comparable value. The Buyer Guarantee applies only to Event Tickets purchased directly through our Site and does not cover Event Tickets obtained from unauthorized sources. We make no guarantee regarding the existence, quality, safety, or legality of Event Tickets beyond what is provided under this Buyer Guarantee. Our Buyer Guarantee is intended, at all times, to comply with all applicable state laws, including those that require the refund of any Event Ticket for a canceled event.
If replacement tickets are provided under the Buyer Guarantee, such tickets may be located in a different section, row, or seating location than originally purchased, provided that the replacement tickets are reasonably comparable in value to the tickets originally purchased, as determined by us in our sole discretion.
The remedies described in this Buyer Guarantee constitute the purchaser’s sole and exclusive remedy for any ticket fulfillment issues.
11. Opening Acts / Festival Acts
Opening acts, guests, or undercards (each an “Opening Act”) may sometimes tour with headlining performers. We are not always made aware of Opening Acts or the length of their performances. Opening Acts, as well as festival performers, are subject to change or cancellation at any time without notice. No refund will be owed if an Opening Act or festival performer is changed or canceled.
12. Canceled, Postponed, Rescheduled, and Moved Events
Occasionally, events are canceled, postponed, rescheduled to a different date or materially different time, or moved to a different venue:
If the event is canceled: No action is required to obtain a refund; we will issue a refund to the original method of payment used at the time of purchase, once funds are received from the Event Organizer. Refunds will only be made on active purchases which have not been canceled prior to the cancellation of the Event Ticket by the Event Ticket organizer, producer, or venue. In some cases, the Event Organizer may also offer you the option to choose between a credit or a refund. If so, we will send you a notification explaining your options and how to submit a request for a credit. You may be required to retain your Event Tickets for canceled events and return them to us or the Event Organizer, as directed by us or the Event Organizer. Our Buyer Guarantee backs all Event Tickets to canceled events. If you did not receive a refund for a canceled event but believe you are entitled to one under applicable state law, please contact us immediately.
If a portion of the event is canceled: In the event an Event is scheduled to occur over multiple days and is subsequently canceled by the Event Ticket organizer, producer, or venue after the start of the Event, Jampack will prorate the refund of the Event Ticket in relation to the amount of days remaining after cancellation. Refunds will only be made on active purchases which have not been canceled prior to the cancellation of the Event Ticket by the Event Ticket organizer, producer, or venue.
If the event is postponed, rescheduled, or relocated: Your Event Ticket(s) (including any additional add-ons or upgrades, such as parking) remain valid, and no further action is required. However, the Event Organizer may approve refunds or the option to choose between a refund and a credit for the event. Any refund and/or credit policies are determined on an event-by-event basis by the Event Organizer and may be subject to limitations set by the Event Organizer. If the Event Organizer approves refunds and/or credits, we will send you a notification explaining your options, and you may submit a request for a refund or credit. Alternatively, you may keep your Event Ticket(s) for the postponed, rescheduled, or moved event. Refunds or credits will not be issued for postponed events unless the event is canceled.
Event Conditions. We are not responsible for conditions at the event venue or the quality of the event experience, including but not limited to obstructed or partially obstructed views, weather conditions, sound quality, production changes, crowd conditions, or venue policies. Such matters are solely the responsibility of the Event Organizer and the venue. Except as expressly provided in this Policy or our Buyer Guarantee, these circumstances do not constitute grounds for a refund.
Any refund issued under this Section will be sent to the payment method on file collected at the time of last payment. Jampack shall not be liable for any failure of refund once Jampack has attempted to process the refund and released the underlying funds, and your sole remedy shall be with your payment provider or bank.
Event Organizers may modify event details, including performers, supporting acts, schedules, and programming, at any time. Changes to performers, supporting acts, event schedules, or event content do not constitute grounds for a refund unless the event itself is cancelled.
We are not responsible for any other event changes, such as partial performances or venue, line-up, or time changes. No refunds or credits will be issued under such circumstances.
13. Refunds and Exchanges
All sales are final. Except as otherwise provided herein or under our Buyer Guarantee, no refunds or exchanges will be issued for Event Tickets purchased, regardless of whether the Event Ticket holder can attend the event. We reserve the right to refuse entry to or eject from the venue anyone who appears to violate our policies. We will not issue a refund for any Event Ticket or any other portion of your purchase if you are denied access to or ejected from an event for engaging in, associating with, or conducting unwanted, unlawful, disruptive, abusive, or offensive behavior.
We are not responsible for lost, stolen, damaged, or misused tickets after delivery or transfer to the customer. Replacement of such tickets, if available, may be subject to additional fees or restrictions imposed by the Event Organizer or venue.
14. Layaway Plan
You have the choice to pay the Event Ticket cost either in full at the time of purchase or in layaway payments. The layaway payment schedule for the Event Ticket cost is specific to each event and your time of purchase and is provided on the Event Ticket purchase page. You are required to make the first payment before we review and confirm your order request. There is an additional fee for each Event Ticket charged for choosing layaway payments. This additional fee will be clearly displayed if you select to pay for the Event Tickets in layaway payments. Once the initial payment is received, the Event Tickets will be set aside and held until the final payment is made. You may pay the remaining balance at any time before the final payment.
Furthermore, you are required to make each additional payment (if any) in accordance with the terms and dates provided on the Event Ticket purchase page. If you fail to make a payment by the payment due date, we shall be entitled, in our sole discretion and with or without prior notice, to (i) treat the missed payment as a breach of contract, (ii) cancel your order without refund, and (iii) impose the cancellation fees specified in this policy. We also retain the right to assign your spot to the next eligible customer on the Waitlist or release your Event Tickets for resale to other customers.
Your order cannot be reinstated after it has been canceled. Still, we may, in our sole discretion (including, but not limited to, subject to availability), allow you to apply some or all of the amounts paid by you to another order or purchase, minus a $100 fee (“Credited Funds”). Credited Funds have no value other than credit against a future purchase from us, and such Credited Funds may expire. Furthermore, the price of your Event Tickets may increase based on availability of Event Tickets – for example, your original order included certain Event Tickets, but after your order was canceled and at the time you want to re-book and apply Credited Funds, the price for the exact Event Tickets has increased for any reason, you will be required to make the increased price difference for such Event Tickets.
We are not responsible for any charges levied or charged by third parties and/or financial institutions resulting from payment transactions related to the purchase of Event Tickets.
If your card payment toward a payment plan is declined, we reserve the right to attempt to re-run the credit card on file on up to 5 days after the missed payment.
The Event Organizer determines the down payment amount, number of installments, and payment schedule. By enrolling in the Layaway Plan, you authorize us to charge your payment method according to the schedule. The Layaway Plan is subject to availability and may not be offered for all events or Event Ticket types. The layaway fee is non-refundable and disclosed before enrollment.
15. Waitlist
For sold-out Event Ticket types, we may offer a free Waitlist service, subject to applicable laws. By joining the Waitlist, you provide a zero-dollar ($0.00) credit card authorization, which we hold solely to secure your position. We will not charge your payment method unless an Event Ticket becomes available and is allocated to you. Depending on the event and ticket type, your card may either be (a) charged automatically when an Event Ticket becomes available, or (b) charged only after you have been notified and confirmed your acceptance of the ticket.
The applicable charging process—whether automatic or notification-based—will be disclosed during the Waitlist registration or allocation process and may vary by event, date, ticket category, or other operational factors. For example, certain high-demand or limited-release ticket types may be automatically processed without prior notice, while others may require your confirmation before any charge occurs.
You may be permitted to remove yourself from a Waitlist or decline an offered ticket prior to charge, depending on the specific Waitlist rules that apply to that event. The Event Organizer determines Waitlist eligibility, including Event Ticket types, pricing tiers, maximum positions, priority rules, fulfillment timing, and the applicable charge or notification process. Joining the Waitlist does not guarantee Event Ticket availability.
16. Insurance Options
During the checkout process, we may offer optional event Event Ticket insurance products provided by a reputable third-party insurer. These Insurance Options are clearly disclosed as optional, and the insurer's policy governs their terms. Purchasing insurance is at your discretion, and we are not responsible for the administration or fulfillment of any insurance claims.
We may also offer an optional Protect Refund Protection product ("Protect") at checkout. If offered, the full Protect fee is charged at the time of purchase in addition to your down payment, and is disclosed prior to enrollment. The Protect fee is separate from, and in addition to, any layaway fee.
If you purchase Protect and your claim is approved by Protect, the following will occur: (i) we will charge all remaining unpaid installments to your payment method on file immediately upon claim approval, so that your order balance is paid in full; (ii) Protect will then issue a refund to you for the full value of your order, including all amounts paid toward the Layaway Plan and the Protect fee; and (iii) the refund will be administered and paid directly by Protect, not by Jampack. By purchasing Protect, you authorize us to charge any remaining installment payments to your payment method upon claim approval as described herein.
Protect is offered by a third-party provider, and the terms, eligibility requirements, and claims process are governed solely by Protect's own policy, which will be made available to you at the time of purchase. Jampack is not responsible for the administration, approval, denial, or fulfillment of any Protect claim. Purchasing Protect does not modify or supersede any other provision of this Event Ticket Purchase Policy, including the provisions governing cancellation, chargebacks, or all-sales-final terms. Protect is optional; your purchase of Event Tickets is not conditioned on enrolling in Protect.
17. Revocable License
Any Event Ticket purchased from us and/or via our Site is a revocable license from a third party for the applicable period. Once you have commenced use of any Event Ticket, the third party reserves the right, without refund of any portion of the price paid or other compensation to you, to refuse admission or reject any person from any applicable facility or event, and/or withdraw or refuse to begin services or provide goods to any person who fails to comply with this Purchase Policy, the rules of an applicable third party, and/or applicable local, state or federal law or ordinance, in whole or in part, or whose conduct is deemed by the applicable third party as disorderly, annoying, illegal, vulgar, abusive, threatening, uncomfortable, aggressive, or out of compliance with this Purchase Policy or the applicable third party’s terms, conditions, rules, or policies (collectively, “Removal Behavior”). Notwithstanding the foregoing, if the third party determines, in its absolute and sole discretion, that before your use of any Event Ticket, you engage in or are reasonably likely to engage in any Removal Behavior, the applicable third party shall have the right to, without any compensation to you, refuse to perform any applicable services or provide any applicable goods.
18. Search, Ejection, and Termination
You and your belongings may be searched by the third-party providing goods/services upon entry to, or otherwise in connection with your attendance at, any event or premises in connection with your transaction with us, a third party, and/or our Site. You hereby consent to such searches by third parties and forever waive any and all related claims that could arise. If you elect to withdraw such consent to such searches, you may be denied access to the corresponding good, product, and/or service without refund or other compensation. Under certain facility rules, certain items may not be brought into certain events or premises, including, without limitation, alcohol, drugs, controlled substances, weapons, cameras, recording devices, laser pointers, strobe lights, irritants, and various forms of containers. Breach of this Purchase Policy or any applicable third party’s terms, conditions, or policies may result in termination of your license to attend the corresponding event or activity or otherwise enjoy the applicable good, product, and/or service, without refund or other compensation.
19. Prohibited Conduct
Use of automated means to purchase Event Tickets is strictly prohibited. We reserve the right to cancel any orders placed in violation of this policy. You may not use Event Ticket bot technology to search for, reserve, or purchase Event Tickets through our Site. You are prohibited from using automated Event Ticket purchasing software in connection with our Site and from circumventing any security measure, access control system, purchase limit, or other technological control or measure on our Site. You represent and warrant, at all times, that you are and will remain in compliance with the U.S. Better Online Ticket Sales Act (BOTS Act) and other applicable laws prohibiting the use of bots or automated systems in connection with Event Ticket purchases. In connection with your use of our Site, you shall not attempt to or assist any third party in attempting to: violate any content policy, harm minors, impersonate others, violate laws, register multiple accounts to circumvent limits, conceal your identity, or stalk/harass others. You agree that you will not attempt to, or assist any third party in attempting to, do any of the following: license or sell our services, copy or reproduce content, modify or reverse engineer our Site, interfere with its functioning, use bots or crawlers, or use unauthorized software. Any unauthorized use of our Site shall result in the automatic and immediate termination of any licenses granted by us and/or suspension or termination of your account.
20. Account Registration and Conduct
To access or use certain features of our Site, you may be required to register an account with us (an “Account”). To open an Account, you represent that you are not a person barred from using our Site under the laws of the United States, your place of residence, or any other applicable jurisdiction. You agree not to create an Account or use our Site if you have previously had an Account terminated by us, or if you have been previously banned from our Site. You are responsible for all activities that occur on your Account, whether or not you are aware of them. To register and maintain a valid Account, you agree to provide true, accurate, current, and complete information about yourself as prompted by the registration process. You agree to maintain and promptly update such information to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your Account and refuse any and all current or future use of our Site (or any portion thereof). You agree not to create an Account using a false identity or information, or on behalf of someone other than yourself. You may not share your Account or password with anyone, and you agree to (a) notify us immediately of any unauthorized use of your password or any other breach of security, and (b) exit from your Account at the end of each session. We reserve the right to remove or reclaim any username at any time and for any reason, including but not limited to claims by a third party that a username violates the third party's rights. You must provide all necessary equipment and software to connect to our Site, such as a mobile device suitable for connecting with and using our Site. You are solely responsible for any fees, including internet connection or mobile fees, that you incur when accessing or using our Site.
21. Resale
Resale of Event Tickets is strictly prohibited in all cases. We do not authorize or facilitate any resale of Event Tickets purchased through our Site. Any attempt to resell or offer for resale an Event Ticket, whether through our Site or any other channel, will result in immediate cancellation of the Event Tickets without refund. We do not permit speculative ticketing, which means the sale of Event Tickets for which the seller has neither possession nor the right to receive an Event Ticket consistent with the description. We reserve the right to request proof of purchase or other evidence for any Event Ticket suspected of being involved in unauthorized activities. Any resale or attempted resale in violation of this Purchase Policy or applicable law will invalidate your Event Ticket purchase and revoke any license granted thereunder. Unlawful resale (or attempted unlawful resale) of an Event Ticket (including, without limitation, producing counterfeit or copies of Event Tickets) is grounds for seizure and cancellation without refund of not only the Event Ticket but also your purchase in full. Event Tickets may not be used for advertising, promotions, contests, or sweepstakes without our express formal written authorization.
22. Credit/Debit Card Chargeback Policy
By purchasing Event Tickets, you agree that chargebacks are not an appropriate way to avoid our cancellation and refund policy. You further agree that you will not initiate a chargeback or payment dispute with your payment provider for any authorized charge related to your Event Ticket purchase except as required by applicable law or payment network rules. Should you attempt to charge back any authorized charge, we will vigorously dispute the charge (including providing this agreement and any other relevant documentation as proof that you agreed to our cancellation and refund terms). We also reserve the right to report fraudulent chargebacks to authorities. Should we successfully refute any chargeback that you initiate, you agree to reimburse us for all reasonable costs and expenses incurred in responding to the chargeback, including attorneys’ fees, chargeback fees, and administrative expenses.
If you file a chargeback request/dispute but elect to reinstate your Event Ticket purchase thereafter (with such request for reinstatement subject to our sole discretion and subject to availability), please be advised that you will be charged a $100 reinstatement fee that must be paid at the time of reinstatement. Furthermore, we may require you to pay for the Event Ticket purchase in full at the time of reinstatement.
We may also suspend or permanently terminate your account and purchasing privileges if we determine that a chargeback was submitted in bad faith.
Nothing in this section is intended to restrict any rights that may be available under applicable payment network rules or applicable law. All payment disputes remain subject to the operating rules of the applicable payment network and payment processor, and those rules shall control to the extent required by applicable law.
23. Dispute Resolution; Arbitration Agreement
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the Site, the purchase or use of Event Tickets, this Event Ticket Purchase Policy, or any transaction or relationship between you and us (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court.
The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its applicable Consumer Arbitration Rules then in effect. The parties agree that this agreement evidences a transaction involving interstate commerce and shall therefore be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16. The arbitration will be conducted by a single neutral arbitrator and may be conducted remotely, by written submissions, or in the county where you reside, unless the parties agree otherwise. The arbitrator shall have the authority to award any relief that would otherwise be available in a court of competent jurisdiction, subject to the limitations set forth in this Agreement. Judgment on the arbitration award may be entered in any court having jurisdiction.
If twenty-five (25) or more arbitration demands asserting similar claims are filed by the same or coordinated counsel, the parties agree that the arbitration administrator shall consolidate the administration of such claims and the arbitrator may require staged proceedings, including the selection of a limited number of representative cases to proceed first. The remaining claims shall be stayed pending the outcome of those representative proceedings. The parties agree to cooperate in good faith to implement procedures designed to reduce arbitration costs and promote the efficient resolution of the claims.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court if the claim qualifies under the applicable rules of that court.
If any portion of this arbitration provision is determined to be unenforceable with respect to a particular claim or remedy, the remainder of the arbitration provision shall remain in full force and effect and shall be enforced to the fullest extent permitted by law. To the extent any dispute is permitted to proceed in court rather than arbitration, the parties knowingly and voluntarily waive any right to a trial by jury.
24. Class Action Waiver
To the fullest extent permitted by law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Site, any Event Ticket purchase, or these Terms shall be resolved only on an individual basis and not in a class, collective, consolidated, or representative action. You and we expressly waive any right to bring or participate in any class action, class arbitration, private attorney general action, or other representative proceeding. The arbitrator shall have no authority to conduct or preside over any form of class, collective, or representative arbitration.
25. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the purchase or use of Event Tickets, including but not limited to travel costs, lodging expenses, lost profits, or other related expenses. Our total liability arising out of any ticket purchase shall not exceed the total amount paid by you for the applicable Event Ticket.
26. Force Majeure
We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, government orders, labor disputes, power failures, internet or telecommunications disruptions, cyberattacks, public health emergencies, acts of terrorism, civil unrest, venue closures, or failures of third-party systems used to process ticket transactions or deliver Event Tickets.
27. Governing Law
This Purchase Policy is governed by the laws of the State of Nevada, without regard to conflict of laws principles.

Jampack Travel Package Purchase Policy (March 12, 2026)
Please carefully and thoroughly read this agreement – it is a legally binding contract.
1. BOOKING CONTRACT
All purchases are made with Fuse Technologies, Inc., D.B.A. Jampack (“Jampack,” “we,” “our,” or “us”). When you purchase any product or book any Trip (as defined herein) with Jampack, You, on behalf of yourself and any of your guests or travelers using any of the products or services of the Trip you are purchasing (“Guests”), will be deemed to have entered into this agreement on behalf of all Guests named in the booking with Jampack (the “Agreement”).
Jampack acts solely as an intermediary marketplace arranging services provided by independent third-party suppliers, including hotels, event organizers, and activity providers. Jampack does not own, operate, or control such suppliers and is not responsible for their acts, omissions, errors, representations, warranties, breaches, or negligence.
Important: This Agreement governs all purchases other than standalone Event Ticket sales, including but not limited to travel packages and Trips that contain any combination of lodging, transportation, event tickets, or Add-Ons. If you are purchasing only an Event Ticket and no other travel-related products or services, your purchase is governed exclusively by our separate Jampack Ticket Purchase Policy, not by this Agreement. If your Trip includes Event Tickets, the purchase, delivery, transfer, and use of those Event Tickets are also governed by the Jampack Ticket Purchase Policy, which is incorporated into this Agreement by reference. Event tickets included in Travel Packages are subject to the Jampack Ticket Purchase Policy, which governs all ticket-related terms, delivery obligations, and remedies.. In the event of a conflict between this Travel Package Purchase Policy and the Event Ticket Purchase Policy with respect to Event Tickets, the Event Ticket Purchase Policy will control for matters relating to Event Tickets.
The Agreement contains the entire understanding between you, the Trip participant (“participant,” “traveler,” “customer,” “you,” or “I”), Guests, and Jampack with respect to all transactions made with us and to any and all services or products organized, arranged, or provided by us or a third party, which may include hotel, lodging, or camping accommodations (all encompassed by “Hotel Accommodations”), transportation, admission or entry to an event (“Event Ticket”), and/or additional services not central to any travel component of the booking (e.g., an open bar at a venue, club access, etc.) (“Add-On”) (collectively referred to herein as “Trip”; “Trip” may also be used to refer to one component or some combination therein of our services).
This Agreement is subject to, and incorporates by reference, the Jampack Privacy Policy and Terms, and are in addition to any other information posted by Jampack and the terms of use or purchase policies set for by any of Jampack’s affiliates or third-party partners affiliated with any of Jampack’s offerings.
By making any transaction, including, without limitation, the purchase, enjoyment, attendance or other use of any Trip with/from Jampack, a third party, and/or the Jampack website, you (and your parent or legal guardian, if you are a minor) acknowledge and agree to be bound by the terms and conditions set forth in this Agreement and that you are at least thirteen (13) years of age.
If you do not agree to this Agreement, in whole or any part thereof, do not purchase, enjoy, attend, or otherwise use any Jampack-related Trip and/or service, or enter into any Jampack-related transaction. Be sure to return to this Agreement periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify this Agreement without prior notice.
2. CLAIMS & COMPLAINTS
If you have a complaint about your Trip, you agree to inform our Support Team immediately via https://www.jampack.com/contact-us so that they can attempt to rectify the matter. Jampack assumes no liability for complaints that are not properly brought to the attention of the Support Team with sufficient notice to resolve or attempt to resolve complaints. Any complaint made after the completion of a Trip must be received via the email associated with the purchase to wegotyou@jampack.com within 7 days from the end of the Trip. You acknowledge and agree that Jampack has no obligation to respond to or address any claims received after this period or sent via methods not specifically provided in this section.
All Trip prices for events that occur in the United States are stated in U.S. Dollars, unless otherwise noted.
4. EVENT TICKETS
Event Tickets included as part of a Trip may be provided by Event Organizers (such as artists, venues, teams, promoters, leagues, or other event producers) or by independent third-party ticket suppliers, including licensed ticket brokers or resellers. In certain cases, Event Tickets included within a Trip may be resale marketplace tickets originally issued by an Event Organizer and subsequently resold by a third-party seller.
Jampack facilitates the purchase and delivery of Event Tickets included in a Trip but does not own, control, or guarantee ticket inventory supplied by Event Organizers or third-party sellers. Event Organizers, not Jampack, are responsible for their events, including organizing, scheduling, staging, postponing, rescheduling, cancelling, and establishing policies governing the event.
Event Tickets included within a Trip remain subject to the Jampack Event Ticket Purchase Policy as well as the terms, conditions, rules, and policies established by the applicable Event Organizer and venue (collectively, the “Event Rules”). By purchasing a Trip that includes Event Tickets, you agree to comply with all Event Rules.
Event Tickets are revocable licenses issued by the Event Organizer or venue. The Event Organizer, venue, or their authorized representatives may refuse admission to, or eject, any person from an event for failure to comply with Event Rules or for engaging in unlawful, disruptive, abusive, or unsafe behavior. If you, your Guests, or any travelers in your room are denied entry to or ejected from an event for such reasons, no refund will be provided for the Event Ticket or for any other portion of the Trip, including Hotel Accommodations or Add-ons.
Seating charts and venue maps displayed on the Site are provided for illustrative purposes only and may not reflect the final layout of the venue. Event Organizers and venues may modify seating arrangements, stage placement, row configurations, or venue layouts at any time, including after tickets are purchased. Such changes do not entitle the traveler to any refund, credit, or exchange unless otherwise required by applicable law.
For certain events, the section and row (or comparable location description) may be displayed at the time of purchase while the specific seat numbers may not be available until after the purchase is completed. In such cases, the exact seat numbers will be provided when the tickets are delivered or transferred. Tickets may be delivered through electronic transfer, mobile ticketing platforms, digital wallets, downloadable files, or other delivery methods depending on the Event Organizer, venue, or ticket supplier.
Event lineups, performers, speakers, and participants may change without notice, and such changes do not entitle travelers to any refund, credit, or exchange.
Finally, you understand that if your Trip is not finalized pursuant to Section 13 of this Agreement (including but not limited to a Guest or traveler in your room’s failure to finalize the booking by the applicable deadline), and as such, your Event Ticket is not considered purchased until Section 13 of this Agreement has been completed by You and Your Guests (if any). If You and/or Your Guests fail to complete Section 13 of this Agreement, any money you (and any of your Guests or travelers within your room) have paid to us is non-refundable.
5. EVENT TICKET DELIVERY
You agree to provide us with the information necessary for the delivery of Event Tickets, including, as applicable, your email address and physical address. If you provide incomplete or incorrect information for the delivery of Event Tickets, or you are unavailable to receive the Event Tickets when they are delivered, you will not be eligible for a refund.
By completing your purchase, you acknowledge and accept the delivery timeline disclosed during checkout or in your order confirmation.
6. HOTEL ACCOMMODATIONS
Hotels and accommodations included in Travel Packages are provided by independent third-party suppliers. Jampack does not control hotel operations and is not responsible for the acts, omissions, or policies of any accommodation provider. You agree to follow the laws, rules, policies, protocols, terms, and conditions of the hotel owner and/or operator (“Hotel Rules”), as well as policies or protocols put in place by local, state/provincial, and federal governments.
Where a booking is fulfilled through a partner, it is also governed by that partner’s traveler terms and conditions — including their policies on cancellations, changes, and refunds. The terms applicable to your specific booking, including any cancellation or refund policy, are shown to you before you complete your purchase. Supplier traveler terms and conditions are available here.
Hotel Rules may include but are not limited to: (i) minimum age (for example, the Hotel Accommodations provider may require that at least one (1) person in every room booked be at least twenty-one (21) years old at the time of check-in); (ii) a valid driver’s license or passport upon check-in, (iii) a credit card or cash deposit upon check-in to cover additional expenses incurred during your stay; and (iv) a credit card or cash deposit upon check-in to cover additional expenses incurred during your stay (such deposit is unrelated to any payment received by us for your Trip).
You agree that bed and room requests cannot be guaranteed by us and are assigned at the discretion of the Hotel Accommodations provider. Special requests such as single rooms, lower floors, connecting rooms, smoking preference, and ADA-accessible rooms must be made at the time of check-in. There may be additional charges for such requests which will be the sole expense of the guest making the request.
If you are a member of any rewards program, you will not receive points for your stay.
When necessary, we reserve the right to substitute other similar-quality Hotel Accommodations for Hotel Accommodations listed. Such substitutions may be made at any time and with or without prior notice. We are not responsible for hotel over-bookings; should the Hotel Accommodations provider over-book your Trip, we will undertake to find similar accommodations in the same area. Such substitutions are at our sole discretion and no refunds will be offered for changes in Hotel Accommodations.
Suppose the correct price of a hotel accommodation we sell is higher than our stated price. In that case, at our discretion, we will contact you for instructions before shipping or cancel your order and notify you of such cancellation.
We will not issue a refund for the Hotel Accommodations portion of your Trip or any other portion if you are denied access to or are ejected from a hotel.
Finally, you understand that if your Trip is not finalized pursuant to Section 13 of this Agreement (including but not limited to a Guest or traveler within your room’s failure to finalize the booking by the applicable deadline), Jampack reserves the right to cancel the Hotel Accommodations without refund of any money paid by you (and/or any of your Guests or travelers within your room) and release the inventory back for sale.
7. ADD-ONS
If your Trip includes any Add-Ons, such Add-On will be provided by a third party and not Jampack. You (on behalf of yourself and your Guests) acknowledge and agree that you will be bound by the laws, rules, policies, protocols, terms, and conditions of the Add-On service provider owner and/or operator and the local, state/provincial, and federal governments. We make no representation or warranty as to any Add-On to be provided or as to any restrictions placed on the use or enjoyment of the Add-On by either the Add-On service provider or applicable law.
If the correct price of an Add-On sold by us is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
Finally, you understand that if your Trip is not finalized pursuant to Section 13 of this Agreement (including but not limited to a Guest or traveler within your room’s failure to finalize the booking by the applicable deadline) Jampack reserves the right to cancel any Add-On and released back into inventory and any money you (and/or any of your Guests or travelers within your room) have paid to us is non-refundable.
8. REVOCABLE LICENSE
Any Trip purchased from Jampack and/or via the Jampack website is a revocable license from a third party for the applicable period. Once you have commenced use of any Jampack product and/or service, any portion thereof, the third party reserves the right, without refund of any portion of the price paid or other compensation to you, to refuse admission or reject any person from any applicable facility or event, and/or withdraw or refuse to begin services or provide goods to any person who fails to comply with this Agreement, the rules of an applicable third party, and/or applicable local, state or federal law or ordinance, in whole or in part, or whose conduct is deemed by the applicable third party as disorderly, annoying, illegal, vulgar, abusive, threatening, uncomfortable, aggressive, or out of compliance with this Agreement or the applicable third party’s terms, conditions, rules, or policies (collectively, “Removal Behavior”). Notwithstanding the foregoing, if the third party determines, in its absolute and sole discretion, that prior to your use of any Jampack product or service, you engage in or are reasonably likely to engage in any Removal Behavior, the applicable third party shall have the right to, without any compensation to you, refuse to perform any applicable services or provide any applicable goods.
9. SEARCH, EJECTION, AND TERMINATION
You and your belongings may be searched by the third party providing goods/services upon entry to, or otherwise in connection with your attendance at, any event or premises in connection with your transaction at Jampack, a third party, and/or the Jampack website. Breach of this Agreement or any applicable third party’s terms, conditions, or policies may result in termination of your license to attend the corresponding event or activity or otherwise enjoy the applicable good, product, and/or service, without refund or other compensation.
10. PRICING & CORRECTION
Jampack endeavors to publish and maintain accurate prices and information for its services. In the event, however, that a service is listed or provided at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from our affiliates and/or providers, Jampack retains the right to refuse or cancel any purchase for such services. Jampack shall have the right to refuse or cancel any such purchase whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your purchase is canceled because of incorrect information. Jampack will promptly issue a credit to your credit card account in the amount of the charge.
If Jampack needs to make any changes to your purchase, we will advise you of such changes as soon as possible. If Jampack needs to make any significant changes to your purchase prior to commencement or use of any Trip, we will notify you with the details of the changes and the revised prices. At that point, you can (i) accept the changes and new prices, (ii) if available, accept a substitute that is equivalent to or greater in value (which may include additional fees) to the original Trip under your purchase, or (iii) if available, accept a substitute that is lower in value or quality to the one you purchased, or (iv) cancel your purchase for a full refund.
Jampack reserves the right to adjust the package price post-booking to account for variations in:
Taxes and fees on travel services (e.g., airport charges), or
Exchange rates relevant to the package.
If the price increase exceeds 8%, the customer has the right to terminate the contract without penalty and receive a full refund. Any price reductions due to decreases in the above costs will also be passed on to customers.
11. THIRD PARTIES & AFFILIATE LINKS
The Jampack website and other Jampack documents display information which is provided by third parties and, as such, we cannot check or guarantee the accuracy of such information. Many of the goods and/or services which make up your Trip are provided by third parties in accordance with their own terms and conditions which may limit or exclude such third party’s liability to you. You understand that any violation of any third party’s terms and conditions may result in cancellation of your purchased good and/or service, in your being denied access to the applicable product/services, in your forfeiting of all monies paid, and/or in our debiting your account for any costs we incur as a result of such violation. Jampack’s display of product options offered by third parties does not in any way imply, suggest, or constitute any sponsorship, recommendation, or approval of such third party or its goods or services by Jampack. You agree that Jampack is in no way responsible for the accuracy, timeliness, or completeness of information it may obtain from these third parties. You acknowledge that some third parties offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer.
YOUR INTERACTION WITH ANY THIRD PARTY ACCESSED THROUGH THE JAMPACK WEBSITE OR OTHERWISE IN CONNECTION WITH A JAMPACK OFFERING IS AT YOUR OWN RISK, AND JAMPACK WILL HAVE NO LIABILITY WITH RESPECT TO THE ACTS, OMISSIONS, ERRORS, REPRESENTATIONS, WARRANTIES, BREACHES, NEGLIGENCE, GOODS, SERVICES, PERSONNEL AND/OR FACILITIES OF ANY SUCH THIRD PARTY AND FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM YOUR INTERACTIONS WITH ANY THIRD PARTY. WE ACCEPT NO RESPONSIBILITY FOR INFORMATION SUPPLIED TO US BY THIRD PARTIES AND WE RECOMMEND YOU CONFIRM ALL INFORMATION CONTAINED ON OR LINKED FROM THE JAMPACK WEBSITE WITH THE APPLICABLE THIRD PARTY. IF APPLICABLE, HOTEL INFORMATION PROVIDED VIA JAMPACK (INCLUDING, WITHOUT LIMITATION, RATINGS, PHOTOGRAPHS, LISTS OF HOTEL AMENITIES, AND DESCRIPTIONS OF PROPERTY) ARE PROVIDED BY THE RESPECTIVE SUPPLIERS AND SERVICE PROVIDERS. THIS HOTEL INFORMATION ARE GENERAL GUIDELINES AND WE CANNOT GUARANTEE THEIR ACCURACY. THEY ARE TO BE USED AS A GENERAL GUIDE AND THE RATINGS AND INFORMATION MAY BE AMENDED PERIODICALLY BY THE RESPECTIVE SUPPLIERS TO KEEP CURRENT. Except as set forth in Section 17 of these Booking Conditions, if, for any reason, any third party cancels or is otherwise unable to provide the goods and/or services that are included in a Jampack offering that you have purchased, in whole or in part, your remedy, if any, lies against that third party, and not against Jampack.
PLEASE BE AWARE THAT CERTAIN EVENTS AND/OR OFFERINGS MAY HAVE AGE LIMITS/REQUIREMENTS. PLEASE PAY ATTENTION TO ALL DETAILS OF THE RESPECTIVE GOOD AND/OR SERVICE YOU ARE PURCHASING, AS NO REFUNDS OR EXCHANGES WILL BE AVAILABLE FOR ERRONEOUSLY PURCHASED ITEMS.
All purchases through Jampack involve a third party, and Jampack acts solely as a third-party intermediary between you and various third parties who are promoting, producing, or otherwise providing or making available the goods and/or services you purchase. Jampack provides such third-party goods and services on behalf of such third parties, which means Jampack does not actually set the prices or determine details like times and seating locations, except under certain expressly provided circumstances. Such third-party goods and/or services may be subject to a per-item convenience charge and/or a non-refundable per-order processing fee. In these cases, delivery prices, facility fees, ticketing charges, or other fees will be owed by you in connection with such goods and/or services.
Travel Packages are sold as bundled products combining event tickets, accommodations, and optional travel components. Prices displayed for Travel Packages reflect bundled pricing and may not correspond to the individual retail value of each component.
For purposes of administering refunds or resolving disputes, Jampack reserves the right to internally allocate component values of the Travel Package in its sole reasonable discretion.
The Jampack website and other Jampack documents may contain affiliate links, which means that Jampack may earn a commission if you click on a link and make a purchase. This comes at no additional cost to you.
If you purchase through an affiliate link, your booking will be done directly through our partner. Once you’ve completed your booking, any questions or inquiries about your booking will need to be submitted through the partner site.
12. DYNAMIC PRICING
Trip prices displayed on the Site may be determined by third-party suppliers, including event organizers, hotels, or other providers, or may reflect dynamic market conditions. Prices for Trips and their underlying components (including Event Tickets, Hotel Accommodations, and Add-Ons) may increase or decrease at any time based on supply and demand, inventory availability, supplier pricing decisions, or other market factors.
By completing your purchase, you acknowledge that Trip pricing reflects prevailing market conditions at the time of booking. Once a purchase is completed, the price paid for your Trip will not be adjusted, and Jampack does not provide refunds, credits, or price adjustments based on subsequent price changes.
13. RESPONSIBILITY
Jampack does not own, operate, or control any of the suppliers that provide services for your Trip, including but not limited to Hotel Accommodations, Event Tickets, Add-Ons, or other goods or services connected with your Trip. These suppliers are solely responsible for their performance. Jampack and its owners, employees, shareholders, officers, directors, representatives, volunteers, successors, agents, and assignees are not liable for any negligence, willful act, error, omission, financial insolvency, or default of any supplier or any third party. Jampack does not have any special knowledge about its supplier’s financial condition. A supplier’s goods and services are subject to the supplier’s own terms and conditions and liability waivers, as well as local, state/provincial, and federal laws and regulations.
If the Trip is for an event in France, the following applies:
Liability for Travel Services: Jampack acknowledges its statutory obligations under EU Directive 2015/2302 and French consumer protection laws to ensure that all services forming part of the package, whether provided by Jampack directly or through third-party providers, conform to the agreed contract. In the event of non-performance or improper performance of the travel services, Jampack will take reasonable measures to rectify any issues. Should this prove impossible, Jampack will offer alternative arrangements or compensation, as appropriate. The customer may also seek damages for any loss incurred as a result of service failures.
Travel Assistance During the Journey: In accordance with Article 16 of EU Directive 2015/2302, Jampack will provide prompt and effective assistance to customers encountering difficulties during the trip, particularly if any essential travel services cannot be provided. This assistance will include, but is not limited to, arranging alternative transportation, accommodation, or other services necessary to continue the trip as planned. Where the problem is caused by force majeure, assistance will still be provided, although Jampack reserves the right to charge a reasonable fee to cover additional costs incurred.
14. CUSTOMER INFORMATION
For us to confirm your Trip, you must provide all requested details at the time of booking, including but not limited to you and your Guest’s full names (as per government-issued identification), dates of birth, and any other information requested for the Trip.
The information required from each customer will vary by trip and will be communicated during the booking process. If all requested information is not provided within 30 days of the Trip start date (or at the time of booking if purchased less than 30 days before the Trip start date), Jampack maintains the right to cancel without refunding your Trip and/or Trips purchased by you and assign the spot(s) to the next eligible customer on the Waitlist.
15. TRIP FINALIZATION
Neither your Trip, nor that of any of your Guests, are finalized until (i) you provide all requested personal details as set forth in Section 7, (ii) your account and your travelers within your room’s accounts are paid in full, (iii) the room is finalized with travelers in your room that you select (which can only be done once your travelers within your rooms’ accounts are paid in full), and (iv) the Hotel Accommodations provider confirms the reservation.
You are responsible for coordinating with your selected travelers within your room for the indicated occupancy and ensuring each of these travelers finalizes their Trip by the indicated deadline. If the travelers within your room that you select fail to finalize their Trip by this deadline, your Trip will not be finalized and Jampack reserves the right to cancel your Trip without refund and release the Hotel Accommodations, Event Ticket, Add-Ons, and any other bookings back into inventory.
If one (or more) of your travelers within your room removes themselves from the Hotel Accommodations or cancels after your Trip is finalized, the remaining travelers in your room will be charged the difference in price between the actual Hotel Accommodation’s occupancy and the intended or paid-for occupancy, or the Hotel Accommodations reservation will be subject to cancellation without refund, or subject to change, including but not limited to change in rooming type and Hotel Accommodations.
We reserve the right to treat any reservation that is not fully paid in accordance with the booking and payment terms as a cancellation without refund and subject to the cancellation terms below.
16. WAITLIST
For sold-out Trip types, we may offer a free Waitlist service, subject to applicable laws. By joining the Waitlist, you provide a zero-dollar ($0.00) credit card authorization, which we hold solely to secure your position. We will not charge your payment method unless an Trip becomes available and is allocated to you. Depending on the event and ticket type, your card may either be (a) charged automatically when an Trip becomes available, or (b) charged only after you have been notified and confirmed your acceptance of the Trip.
The applicable charging process—whether automatic or notification-based—will be disclosed during the Waitlist registration or allocation process and may vary by event, date, ticket category, or other operational factors. For example, certain high-demand or limited-release trips may be automatically processed without prior notice, while others may require your confirmation before any charge occurs.
You may be permitted to remove yourself from a Waitlist or decline an offered ticket prior to charge, depending on the specific Waitlist rules that apply to that event. The Event Organizer determines Waitlist eligibility, including Trip types, pricing tiers, maximum positions, priority rules, fulfillment timing, and the applicable charge or notification process. Joining the Waitlist does not guarantee Trip availability.
17. LAYAWAY PLAN
You have the choice to pay the Trip cost either in full at the time of purchase or in layaway payments. The layaway payment schedule for the Trip cost is specific to each event and your time of purchase and is provided on the Trip purchase page. You are required to make the first payment before we review and confirm your order request. There is an additional fee for each Trip charged for choosing layaway payments. This additional fee will be clearly displayed if you select to pay for the Trip(s) in layaway payments. Once the initial payment is received, the Trips will be set aside and held until the final payment is made. You may pay the remaining balance at any time before the final payment.
Furthermore, you are required to make each additional payment (if any) in accordance with the terms and dates provided on the Trip purchase page. If you fail to make a payment by the payment due date, we shall be entitled, in our sole discretion and with or without prior notice, to (i) treat the missed payment as a breach of contract, (ii) cancel your order without refund, and (iii) impose the cancellation fees specified in this policy. We also retain the right to assign your spot to the next eligible customer on the Waitlist or release your Trip(s) for resale to other customers.
Furthermore, the price of your Trip(s) may increase based on availability of Trip(s) – for example, your original order included certain Trip(s), but after your order was canceled and at the time you want to re-book and apply Credited Funds, the price for the exact Trip(s) has increased for any reason, you will be required to make the increased price difference for such Trip(s).
We are not responsible for any charges levied or charged by third parties and/or financial institutions resulting from payment transactions related to the purchase of Trip(s).
Jampack is not responsible for any charges levied or charged by third parties and/or financial institutions resulting from payment transactions related to purchasing Jampack Trips or products. Those fees are your responsibility, and we will not refund or reimburse those fees.
If your card payment toward a payment plan is declined, Jampack reserves the right to attempt to re-run the credit card on file for up to 5 days after the missed payment.
18. CREDIT/DEBIT CARD CHARGEBACK POLICY
By purchasing a Trip, you agree that chargebacks are not an appropriate way to avoid our cancellation and refund policy. You further agree you will not initiate a chargeback or payment dispute with your payment provider for any authorized charge related to your Trip purchase except as required by applicable law or payment network rules.
If you file a chargeback request/dispute but elect to reinstate your Trip purchase thereafter (with such request for reinstatement subject to our sole discretion and subject to availability), please be advised that you will be charged a $100 reinstatement fee that must be paid at the time of reinstatement.
19. EVENT CANCELLATION, POSTPONED OR RESCHEDULED
UNFORTUNATELY, ON OCCASION, TRIPS OR EVENTS MAY BE CANCELED, RAINED OUT, POSTPONED, RESCHEDULED, OR OTHERWISE MODIFIED, AND CERTAIN AMENITIES, ARTISTS, PERFORMERS, OR OTHER ASPECTS OF THE TRIP APPLICABLE TO YOUR TRANSACTION MAY BE ALTERED OR CANCELED FOR ANY REASON OR NO REASON. SHOULD THIS OCCUR, JAMPACK WILL USE COMMERCIALLY REASONABLE EFFORTS TO CONTACT YOU REGARDING ANY APPLICABLE PROCEDURES. JAMPACK SHALL NOT BE LIABLE FOR ANY SUCH CANCELLATIONS, RAIN OUTS, POSTPONEMENTS, RESCHEDULES, OR OTHER CHANGES TO THE TRIP, AND ANY REMEDIES AVAILABLE TO YOU SHALL BE LIMITED AS SET FORTH BELOW.
NOTWITHSTANDING ANYTHING CONTAINED HEREIN, IN THE EVENT OF CANCELLATION BY THE EVENT TICKET ORGANIZER, PRODUCER, OR VENUE OF THE UNDERLYING EVENT, THE EVENT TICKET PORTION OF THE TRAVEL PACKAGE SHALL BE GOVERNED SOLELY BY THE JAMPACK TICKET PURCHASE POLICY.
ALL OTHER COMPONENTS OF THE TRAVEL PACKAGE, INCLUDING BUT NOT LIMITED TO HOTEL ACCOMMODATIONS, TRAVEL SERVICES, ADD-ONS, EXPERIENCES, OR ANY OTHER TRIP COMPONENTS, ARE NON-REFUNDABLE AND SHALL NOT BE ELIGIBLE FOR REFUND IN THE EVENT THE UNDERLYING EVENT IS CANCELED.
FOR THE AVOIDANCE OF DOUBT, IF A TRAVEL PACKAGE INCLUDES AN EVENT TICKET, HOTEL ACCOMMODATIONS, AND/OR ADD-ONS, AND THE EVENT IS CANCELED AT ANY TIME PRIOR TO OR DURING THE EVENT, THE PURCHASER SHALL ONLY BE ELIGIBLE FOR ANY REMEDY AVAILABLE UNDER THE JAMPACK TICKET PURCHASE POLICY WITH RESPECT TO THE EVENT TICKET PORTION OF THE TRAVEL PACKAGE. NO REFUND SHALL BE PROVIDED FOR HOTEL ACCOMMODATIONS, ADD-ONS, OR ANY OTHER TRAVEL PACKAGE COMPONENTS.
IN THE EVENT AN EVENT IS SCHEDULED TO OCCUR OVER MULTIPLE DAYS AND IS SUBSEQUENTLY CANCELED AFTER THE EVENT HAS COMMENCED, ANY REFUND OF THE EVENT TICKET PORTION SHALL BE DETERMINED IN ACCORDANCE WITH THE JAMPACK TICKET PURCHASE POLICY.
ANY REFUND ISSUED PURSUANT TO THIS SECTION SHALL BE PROCESSED TO THE PAYMENT METHOD ON FILE USED FOR THE MOST RECENT PAYMENT. JAMPACK SHALL NOT BE LIABLE FOR ANY FAILURE OF A PAYMENT PROVIDER OR FINANCIAL INSTITUTION TO COMPLETE A REFUND AFTER JAMPACK HAS INITIATED THE REFUND PROCESS.
If your Trip is for an event in France, the following shall apply: In accordance with EU and French consumer protection laws, if Jampack cancels the package or makes significant changes (e.g., alterations to essential services such as accommodations or travel schedules), the customer has the right to:

Or cancel the booking and receive a full refund within 14 days of cancellation.
Significant changes include, but are not limited to, changes to the date of departure, destination, or essential service quality.
20. CANCELLATION BY TRAVELER
Other than allowed by applicable law, the Trip is non-refundable – if you elect to cancel the Trip or the Trip is canceled due to your failure (or your selected travelers within your room’s failure) to finalize your Trip as set forth in Section 8 above, or any portion of the Trip, no refund will be given for any reason or under any circumstances.
Other than allowed by applicable law, there are no exceptions to this cancellation policy, including but not limited to reasons related to weather; terrorism; civil strife or unrest; airline default; strikes; personal, family, or medical emergencies; or any other circumstances beyond our control. This means that even if you cancel because of medical issues, virus, sickness, quarantine, travel restrictions/warnings, fear of traveling, or any other reason, your booking will be subject to this cancellation and refund policy.
If your Trip is for an event in France, the following shall apply, Right to Withdrawal (Cooling-off Period): Pursuant to EU Directive 2015/2302 and applicable French law, customers have the right to withdraw from the contract within 14 days from the booking confirmation without incurring penalties, unless the booking is made within 30 days prior to departure or under specific promotions where the withdrawal right is excluded. In such cases, Jampack will provide clear notification of any non-applicability of this right. Notice of withdrawal must be sent in writing, and any amounts paid will be refunded within 14 days.
If you are quarantined or a supplier refuses services if you exhibit symptoms of or test positive for infectious disease, we cannot provide refunds for any unused portion of your Trip. Moreover, we will not have any liability to you nor owe you any refund or compensation for loss, damage or injury, or anything else if you are infected with an illness, disease, or sickness during your Trip, or if a third party refuses services (e.g., lodging or transport) because you show symptoms of or test positive for infectious disease or illness before, after or during your Trip. For example, we will not be liable to you if you are: infected with a virus such as a coronavirus at Hotel Accommodations that we book for you, refused service at Hotel Accommodations, or are unable to board a plane to or from your Trip for showing symptoms of a communicable illness such as a cough or fever, denied entry by a government or municipality, required to self-quarantine, or for any other reason.
21. MODIFICATION TO YOUR PURCHASE
Modifications to your Trip may be completed at Jampack’s sole discretion. To request a modification to your Trip, please contact Jampack at wegotyou@jampack.com. If Jampack allows for such modification, you agree to pay any associated increase in price at the time of such request to modify your Trip. Prices for modifications to your Trip will be based on the current price of the alternative at the time the modification is made. If the trip's price decreases, Jampack will not issue any refund for such a difference unless the Trip is subject to the No Change Fee promotion below.
Certain limited Jampack Trips and packages will offer a No Change Fee promotion, which will be listed on the Event offer page. If an Event does not have the No Change Fee promotion listed as applicable, the modifications to your Trip is subject to the paragraph above.
For Jampack Trips and packages offering a No Change Fee promotion (this promotion must be explicitly listed on the Event offer page; please email wegotyou@jampack.com for a complete list of Events offering this No Change Fee promotion), up to 45 days before the first date of your Trip, You and Your Guest’s may make certain changes, at no additional fee, to your Trip, only as set forth below:
If Your Trip includes hotel accommodations, you may change hotel accommodations, subject to availability. You will be responsible for any increased costs (or eligible for a refund for any decreased costs), related to such change. However, you CANNOT cancel or remove your Hotel Accommodations, or change your stay pattern (i.e., you book a hotel accommodation for 4 nights and want to change to 3-nights, this is not allowed).
If Your Trip includes an Event Ticket, you may change the Event ticket type, subject to availability. You will be responsible for any increased costs (or eligible for a refund for any decreased costs) related to such change. However, you CAN’T cancel or remove your Hotel Accommodations.
IF your Trip includes an Add-On, you may change, modify, cancel this Add-On. You will be responsible for any increased costs (or eligible for a refund for any decreased costs), related to such change.

All changes must be made in writing to wegotyou@jampack.com.
22. CANCELLATIONS AND CHANGES BY JAMPACK
Jampack reserves the right to cancel, alter or postpone a Trip at any time and with or without prior notice. Jampack will not be responsible for deposits, payments, incidental expenses, policies, or penalties for other services booked with any provider or supplier other than Jampack, such as airline tickets, separate hotel reservations, or other items (such as other travel plans or cruises).
If a Trip is canceled due to reasons within Jampack’s control, we may, within our sole discretion, offer a refund equal to the Trip cost you actually paid, except unrecoverable costs (which may include Hotel Accommodations). If a portion of the Trip is canceled due to reasons within Jampack’s control, Jampack may offer you a refund for ONLY monies actually paid toward the canceled portion of your Trip (minus unrecoverable costs related to the canceled portion of your Trip, including Hotel Accommodations). You understand these unrecoverable costs could mean your refund is a nominal amount if any. If during your Trip, a part of your Trip is canceled for a reason within Jampack’s control, we may offer a reasonable alternative on a pro-rata basis.
Further, from the moment your Trip is booked, Jampack factors into the Trip price a fee of $200 to cover the work involved in planning, booking, and organizing your Trip. If a Trip is to be canceled, withdrawn, altered, modified, postponed, or rescheduled, Jampack may, at their absolute discretion and regardless of their control of the situation, incorporate this fee as an unrecoverable cost.
You understand and acknowledge that, due to the unpredictable nature of your Trip, you are expected to be flexible in your travels and allow for alternatives. The itinerary provided for each Trip is representative of the types of activities that will be included and their approximate times and dates but is not a guarantee. While Jampack will do its best to operate all Trips as advertised, we may, at our sole discretion, deem it necessary to make reasonable changes to your itinerary.
We shall not be deemed to be in breach of this agreement or otherwise liable to you because of delay or failure in our performance of any obligations hereunder due to any cancellations, alterations, or modifications under this section.
The cancellation, postponement, or rescheduling of an Event Ticket is NOT considered a cancellation and/or change by Jampack. Such cancellation is not covered under this section but is instead covered by Section 14.
If your Trip is for an event in France, the following shall apply: In accordance with EU and French consumer protection laws, if Jampack cancels the package or makes significant changes (e.g., alterations to essential services such as accommodations or travel schedules), the customer has the right to:
Accept the proposed changes;
Accept an alternative package of equivalent or superior value, if offered;
Or cancel the booking and receive a full refund within 14 days of cancellation.
Significant changes include, but are not limited to, changes to the date of departure, destination, or essential service quality.
WITHOUT LIMITING ANYTHING SET FORTH HEREIN OR ANY OTHER RIGHTS OF JAMPACK, IF THE GOOD AND/OR SERVICE IS CONTROLLED SOLELY AND DIRECTLY BY JAMPACK, THEN, EXCEPT AS REQUIRED OR SUGGESTED BY THE APPLICABLE AUTHORITY OR LAW, JAMPACK SHALL HAVE THE SOLE AND ABSOLUTE DISCRETION IN MAKING THE FINAL DETERMINATION OF CANCELLATION, DISCONTINUATION, POSTPONEMENT, RESCHEDULING, AND/OR REFUND AVAILABILITY.
23. CANCELLATION FORCE MAJEURE
Jampack will not be deemed in breach of this agreement or otherwise liable to you because of delay or failure in performance of our or a third party’s obligations under this agreement to the extent that such delay or failure is due to any circumstance(s) beyond Jampack’s reasonable control, including without limitation acts of nature and/or God; weather conditions; flood; tempest; forceful wind; fire; earthquake; windstorm; explosion; accident; terrorist activities; electronic viruses or worms; failure of website hosting services; insurrection; war or threat of war (whether declared or undeclared); sabotage; hostilities; civil disturbance or commotion; riots; labor strike or lockout; lack of or failure of transportation facilities; lack of or failure of power facilities; requisition; sickness; quarantine; pandemic; epidemic; the spread or concern for spread of disease and/or virus that is known, unknown, or novel (including but not limited to coronavirus/COVID-19); border closing, limitation, or restriction; government intervention of any kind including those that affect domestic and/or international travel; regulation, ordinance, or requirement by any government or governmental agency having or claiming to have jurisdiction over the subject matter of this Agreement or over the parties; or any other unforeseen circumstances (all encompassed by “Force Majeure”).
If Force Majeure prevents, delays, significantly hinders, renders difficult, frustrates, or makes impossible or commercially impracticable our or our suppliers’ ability to provide the services including but not limited to your Trip, we and our suppliers may, in our complete and sole discretion, vary, delay, postpone, reschedule, alter, or cancel any itinerary, arrangement, or booking concerning the Trip, including the entire Trip itself.
In situations of civil unrest, Jampack will investigate the prevailing situation and determine, in our sole and absolute discretion, whether to proceed with the Trip.
If we are affected by Force Majeure, we, if practicable, will notify you of the nature and extent thereof.
EXCEPT AS SET FORTH IN SECTION 17 OF THESE BOOKING CONDITIONS, WITHOUT LIMITING THE FOREGOING, ULTIMATELY, IN CASES OF FORCE MAJEURE, JAMPACK WILL MAKE REASONABLE EFFORTS TO CAUSE THE APPLICABLE THIRD PARTY TO ISSUE A REFUND FOR THE VALUE OF SUCH GOOD AND/OR SERVICE IF POSSIBLE; HOWEVER, NEITHER JAMPACK NOR ANY APPLICABLE THIRD PARTY WILL BE OBLIGATED TO ISSUE YOU A REFUND FOR THE AFFECTED PORTION, OR ANY OTHER ASPECT, OF YOUR TRIP. JAMPACK SHALL NOT BE LIABLE FOR ANY SUCH CANCELLATIONS, RAIN OUTS, POSTPONEMENTS, RESCHEDULES OR ANY OTHER CHANGES TO THE TRIP IN CONNECTION WITH YOUR TRANSACTION, AND YOUR SOLE REMEDY SHALL BE WITH THE APPLICABLE THIRD PARTY.
24. INSURANCE AND REFUND GUARANTEE PROTECTION
During the checkout process, we may offer optional event Trip insurance or refund guarantee products provided by a reputable third-party. These options are clearly disclosed as optional, and the provider’s policy governs their terms. Purchasing one of these products is at your discretion, and we are not responsible for the administration or fulfillment of any claims.
As stated, we may offer an optional Protect Refund Protection product ("Protect") at checkout.

34. LIMITATIONS OF REMEDIES
You agree that the sole remedy for any default by Jampack arising under this agreement shall be the return of the paid Trip cost, to the extent consistent with applicable law. To the maximum extent permitted under applicable law, Jampack shall not be liable for any special, consequential, indirect, incidental, or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under the statute, in equity, at law, or otherwise, even if Jampack has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
35. SUCCESSORS & ASSIGNS
This agreement shall inure to the benefit of and be binding upon Jampack and you and your respective heirs, legal and personal representatives, successors, and assigns, as well as any Guests or individuals to whom you provide or transfer our services.
36. SEVERABILITY
If any provision of this agreement shall be illegal, unenforceable, or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement illegal, unenforceable, or invalid as a whole. Such an unenforceable provision will be replaced with one that is legal, valid, and enforceable and which achieves the original objectives and intent of the original provision to the maximum extent possible.
37. IMAGES RELEASE AND SOCIAL MEDIA
You agree that Jampack may use, re-use, link , repost, and/or reproduce any images, photos, videos, or written content (e.g., blog posts, articles) that you send to us or post online (including on social media) or which are captured by our guides, Trip leaders, and/or other travelers (whether of you individually or in a group) (all encompassed by “Content”). Jampack may utilize the Content free of charge and without your right to inspection in any medium (including but not limited to print, electronic media, or the internet) for the purpose of promoting and publicizing our travel products and services worldwide. If you do not want to grant this specific right to Jampack, you must contact us in writing before the start of your Trip and specifically state that you are opting out of this Section.
38. DISPUTE RESOLUTION AND ARBITRATION AGREEMENT
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the Site, the purchase or use of a Trip(s), this Travel Package Purchase Policy, or any transaction or relationship between you and us (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court.
39. CLASS ACTION WAIVER
To the fullest extent permitted by law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Site, any Trip purchase, or these Terms shall be resolved only on an individual basis and not in a class, collective, consolidated, or representative action. You and we expressly waive any right to bring or participate in any class action, class arbitration, private attorney general action, or other representative proceeding. The arbitrator shall have no authority to conduct or preside over any form of class, collective, or representative arbitration.
40. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the purchase or use of the Trip, including but not limited to travel costs, lodging expenses, lost profits, or other related expenses. To the maximum extent permitted by law, Jampack’s total liability arising from any Travel Package purchase shall not exceed the total amount paid by the purchaser for that Travel Package.
